Terms of Service

1. Agreement

These Terms govern your access to and use of Labterna (the “Service”), operated by Bigini Holding B.V., Amsterdam, the Netherlands (“Labterna”, “we”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation.

2. The Service

Labterna provides an AI “in-silico designer” that runs computational molecular-biology design tasks (for example primer, probe, assay, and construct design) in a private cloud workspace and returns results and reproducibility artifacts.

3. Scientific disclaimer

Outputs are computational design aids for research use, not validated clinical, diagnostic, or therapeutic results. They must be reviewed and experimentally validated by a qualified professional before any laboratory, clinical, or production use. You are responsible for how you use the outputs, and Labterna is not liable for decisions made on the basis of them without appropriate validation.

4. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least 18 years old.

5. Acceptable use

You agree not to use the Service to:

  • break any applicable law or regulation;
  • design, produce, or facilitate biological agents, toxins, or other work intended to cause harm, or that breaches biosecurity or export-control rules;
  • infringe others’ intellectual-property or privacy rights, or submit data you have no right to submit;
  • attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.

We may suspend or terminate accounts that violate this section.

6. Plans, credits & billing

The Service is offered on a free trial and paid subscription tiers, each including a monthly allotment of credits, with optional one-time top-ups. Subscriptions renew automatically each period until cancelled. You can cancel at any time from your account; cancellation stops future renewals and takes effect at the end of the current period. Credits are a usage cap, are consumed as you run tasks, do not represent currency, and are non-refundable except where required by law. Prices may change on prospective notice. Payments are processed by Stripe.

7. Your content & intellectual property

You retain ownership of the inputs you submit and the outputs generated for you. You grant us a limited licence to host and process that content solely to provide the Service to you. You are responsible for having the rights to any data you submit.

8. Our intellectual property

The Service, including its software, models integration, and branding, is owned by Labterna. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

9. Warranties & liability

The Service is provided “as is” without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, Labterna’s total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim, and we are not liable for indirect or consequential losses.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or where required by law. On termination, your right to use the Service ends.

11. Governing law

These Terms are governed by the laws of the Netherlands, and the courts of Amsterdam have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you may have.
